President Trump’s deputy counsel Patrick Philbin on Friday argued why no new witnesses would change the fact that the Democrats’ articles of impeachment on their face are defective.
The New York Times dropped another surprise Bolton story Friday morning ahead of the senate vote on impeachment witnesses.
The Democrats are clamoring to bring in Trump’s former NatSec Advisor John Bolton to testify because he alleged in his new book that Trump tied the US military aid to Ukraine to Biden investigations.
Philbin argued on Friday that no new witnesses will change the fact that the two articles of impeachment are defective.
“These articles of impeachment on their face are defective,” Philbin argued as he dismantled the second article of impeachment “Obstruction of Congress.”
The second article “is really trying to say that it is an impeachable offense for the president to defend the separation of powers. That can’t be right. No witnesses are going to say anything that makes any difference to the second article of impeachment,” he said.
“And on the first article of impeachment, that too is defective on its face,” Philbin said addressing the “Abuse of Power” charge.
Philbin argued once again that President Trump cannot defy any agencies in the executive branch because he alone is the executive branch.
“It’s not a Constitutionally coherent statement,” he said.
